- Rationale

Introduction

"We expect our professors to criticize each other, to debate, to question authority...the actions themselves fall under the realm of educational employment in a university setting...the actions themselves, the actions of criticizing, debating, and questioning authority do serve a legitimate purpose...". [Zeke Wiedenfeld, Court Commissioner, Walworth County Circuit Court]

My name is Chris Henige. I have taught art history at the University of Wisconsin-Whitewater since 2001.

The purpose of this site is to provide all of the documentation associated with my experiences at the university starting in 2012 and carrying through to the present day. I will be starting with the current and moving backward through time, and more materials will continue to appear on this site over time.

The documents, audio and commentary contained in this site are all a matter of public record.

- Complaint 4

Exhibit 33 - Jan 26, 2015 - Complaint

Complaint 4 by Melton
Commentary:

This complaint is virtually identical to that filed as part of the petition for temporary Restraining order, and so does not require a blow-by-blow annotation. See the TRO documentation for that.

Exhibit 34 - Feb 20, 2015 - Complaint

Memo informing me of Complaint 4 by Melton
Commentary:

The phrase "you have certain rights and protections as more fully described under UWW Chapter VI" implies that these rules actually matter, and will be followed. See documentation for Second Kangaroo Court to see how that turned out.

Exhibit 35 - May 14, 2015 - Investigation

Investigator's Report
Commentary:

This document has an exhibit number on it because it was never sent to me directly. I received it as part of the exhibits for the hearings, months after the charge was sent to me.

Exhibit 236 - May 14, 2015 - Investigation

Annotated Investigator's Report
Commentary:

Annotated version of the Investigator's Report.

Exhibit 36 - May 21, 2015 - Charge

Chancellor Telfer's Charge
Commentary:

Telfer's charge relies entirely on the Investigator's Report, which was not provided to me until just before the hearings. It does not require annotation because I have annotated the Investigator's Report. Of particular import here is item 2 of the proposed penalties: "You will be prohibited from engaging in unmediated correspondence with the chair of your department or any of the members of the department for the academic year, 2015-2016. This includes any electronic communication including email, any social media, and any telephonic communication." An "academic year" is two semesters. This will matter when the final charge is issued.

Exhibit 37 - Jun 5, 2015 - Charge

Response to Chancellor Telfer's Charge
Commentary:

An agreement was reached to suspend the timeline of the proceedings until the Fall semester.

Exhibit 233 - Jun 25, 2015 - Negotiations

Summer Negotiations
Commentary:

This tends to speak for itself.

- It was at this point that I searched for statutes regarding extortion, because that is surely what this felt like.

Exhibit 537 - Jun 26, 2015 - Negotiations

"My" Letter of Apology
Commentary:

I did not author this. One of the demands of the Dean was that I write a letter of apology. The version I wrote is found in the next entry.

Exhibit 538 - Jun 26, 2015 - Negotiations

Original Letter of Apology
Commentary:

No weight can be placed on this document. It was extorted, under duress, in exchange for a semester's pay and benefits, and was modified by the Dean to suit his purposes. See previous entry.

Exhibit 234 - Jun 30, 2015 - Negotiations

Deferred Discipline Agreement
Commentary:

The highlighted passages strip away my rights. Who would agree to this?

Exhibit 235 - Aug 20, 2015 - Negotiations

End of Negotiations
Commentary:

Kopper was correct in reinstating the process, after I "failed" to allow my rights to be stripped from me.

Exhibit 232 - Aug 21, 2015 - Fallout

The Next Day - Return to Exile
Commentary:

At the end of the Spring semester, I was restored to my office and an announcement was made in a department meeting about my return. (See TRO documentation). What happened between then and now? One day after my refusal to sign the Deferred Discipline Agreement, my exile was reinstated without hearing or due process. This was copied to Interim Provost John Stone and Interim Chair Denis Dale.

- Notice the curious carriage returns and spacing, which is likely the product of cutting and pasting and would not normally result from typing in by hand. Whose directive is this, actually?

Exhibit 231 - Sep 7, 2015 - Fallout

Statement by the Chair Regarding Exile
Commentary:

This statement was made by Interim Chair Denis Dale to the faculty explaining my absence. Apart from the fact that I didn't agree to anything, he starts by saying I did. It goes downhill from there.

- If this isn't outright defamation...

Exhibit 38 - Dec 10, 2015 - Hearing

Report of the Hearing Panel
Commentary:

See the documentation for Second Kangaroo Court for the details.

Exhibit 39 - Jan 4, 2016 - Disposition

Final Disposition
Commentary:

The Faculty Personnel Rules in place at the time prohibited the Chancellor from making the penalties more severe than in the original charge, and yet item 2 has been changed from Telfer's original: "You will be prohibited from engaging in unmediated correspondence with the chair of your department or any of the members of the department beginning immediately and continuing through the academic year, 2016-2017. This includes any electronic communication including email and any social media and any telephonic communications." This charge is dated January 4, 2016, and so the penalty has been made more severe by making it three semesters and a summer rather than two semesters.
